Introduction

This privacy notice applies to the personal data that may be collected or used by Koninklijke Philips N.V., Respiratory Technologies, Inc. (“RespirTech”), or their affiliates (collectively referred to as “Philips”). This Privacy Notice provides you with information regarding Philips’ collection, use and disclosure of the personal data processed through the RespirTech.com website, referred to on this site as RespirTech®, and its related marketing, sales and customer service activities. This is a notice about our privacy practices; it is not a contract or agreement.

How your Personal Data is collected and used

Contacting Customer Service

Philips will record your personal data whenever you contact our Customer Care Support Center which you may do by submitting an inquiry via an online form, or calling us directly. Philips will record your contact information (such as name, phone number, and email), your question or request, the date and time and means of the contact (e.g. telephone call, on-line web form, email, etc.) and any other data relevant to your question or request.

As part of our commitment to providing the best possible service to our customers, we might record telephone calls answered in our Customer Care Support Centers. We will notify you in advance if your telephone call is recorded. We may use the recording to:

Help us improve the quality of our customer service, by using information obtained from recorded calls to aid in developing training content and conducting staff training to ensure the information we provide is consistent and accurate;
Produce analytics for reporting purposes related to the types and numbers of inquiries we receive to find ways to simplify our service to you; and
Ensure we have an accurate record of your call, which may be needed to support any transactions that take place over the phone, or to manage our business.

In your interactions with Philips we will not request any sensitive data (e.g. health data) unless specifically relevant to your question or request. We ask that you not provide this kind of information during your interactions with Philips.

If needed during our interface with you, any data collected will primarily be used for answering your question or for the resolution of your request.

Marketing

If you submit an online form to request marketing materials, or product information, your data will be used to provide you the requested materials. If you provide a phone number or email, it may be used to confirm receipt of your request, or verify an address. This information will not be used for any reason other than that outlined on the form where you make your request.

Share your story submission

Should you choose to submit a product experience or testimonial via the form found on our website, Philips will ask for your name, address, email and phone number for the purposes of validating your story and story attribution. All story submissions require you to also review and agree to the terms outlining how your story may be used by Philips. Please consider what information you share and only provide details on that information of which you are comfortable. Submissions may be used as outlined in the terms provided on the website.

Event registration

RespirTech may collect data for professional events, webinars or fairs ("Events") that you may wish to attend and register for via the website. When you register for an event, we will process your business contact information (name, email, business address) and may require the additional following information:

Facility
Modality
Products interested
Date
Time slot
Business phone
Relevant dietary information.

By registering to an event, you are agreeing to receive communications from Philips directly related to the event, such as what location the event will be hosted, what time the event takes place.

Cookies

The RespirTech.com website collects information through cookies or similar techniques regarding your use of the website.

This data will be used to track your use of the website, such as identifying which parts of the website you are interested in, where you spend more time, or engage by clicking on content. This can help us make decisions on what content to provide on the website, or may be used to improve the website experience.
If you’ve clicked through to the website as a result of a marketing campaign, we will record that action and further engagement with the site to inform future marketing communications and strategy.
We also make use of cookies that ensure that the website functions properly.

Personal Data shared with Third Parties

Philips may use trusted third parties to provide certain services for RespirTech.com. Such services may include the processing of personal data, including for the following:

• IT Providers

These providers deliver the necessary hardware, software, networking, storage, transactional services and/or related technology required to run the website and related business processes to provide you with the service requested.

• Cloud Providers

These providers deliver specific services for sending and receiving data between data centers/cloud repositories using secure electronic transfer methods.

Philips requires these service providers to provide a comparable level of protection of your personal data as Philips provides, to only process your personal data for the specific purposes mentioned above, to limit access to the minimum amount of data needed to deliver a specific service, and to require the same of their subcontractors who support them in providing services to Philips.

If Philips allows a third party to transfer your personal data outside of your geographic region, we will take steps to protect your privacy rights through the use of contractual arrangements or other means, which will provide a comparable level of protection while the information is being processed by our third parties.

Philips will disclose personal data only under this privacy notice and/or as required by law.

Philips sometimes sells a business or a part of a business to another company. Such a transfer of ownership could include the transfer of your personal data directly related to that business, to the purchasing company.

Choices and rights

If you would like to submit a request to access, rectify, erase, restrict or object to the processing of personal data that you have previously provided to us, or if you would like to submit a request to receive an electronic copy of your personal data for purposes of transmitting it to another company (to the extent this right to data portability is provided to you by applicable law), you may contact us at privacy@philips.com. We will respond to your request consistent with applicable law.

In your request, please make clear what personal data you would like to have changed, whether you would like to have your personal data suppressed from our database, or otherwise let us know what limitations you would like to put on our use of your personal data. For your protection, we may only implement requests with respect to the personal data associated with your account, your email address or other account information that you use to send us your request, and we may need to verify your identity before implementing your request.

Please note that we may need to retain certain information for recordkeeping purposes and/or to complete any transactions that you began prior to requesting a change or deletion (e.g. when you make a purchase or enter a promotion, you may not be able to change or delete the personal data provided until after the completing of such a purchase or promotion). There may also be residual information that will remain within our databases and other records, which will not be removed.

We will try to comply with your request(s) as soon as reasonably practicable. Please note that if you opt out of receiving marketing-related emails from us, we may still send you important administrative messages, from which you cannot opt out.

If you make use of (some of) your choices and rights, you may not be able to use, in whole or in part, certain Philips Services.

We protect your personal data

We recognize and take seriously our responsibility to protect the data you entrust to Philips from loss, misuse or unauthorized access. Philips uses a variety of security technologies and organizational procedures to help protect your data. For example, we implement access controls, use firewalls, use encryption and use secure servers.

Special information for parents

While the Respirtech.com website is not directed to children, as defined under applicable law, and we do not knowingly collect personal data from children. It is, however, our policy to comply with the law when it requires parent or guardian permission before collecting, using or disclosing personal data of children. We are committed to protecting the privacy needs of children and we strongly encourage parents and guardians to take an active role in their children's online activities and interests.

If a parent or guardian becomes aware that his or her child has provided us with his or her personal data without their consent, please contact us at privacy@philips.com. If we become aware that a child has provided us with personal data, we will delete his/her data from our files.

Linking to other websites

During your online journey across RespirTech.com or other Philips websites, you may encounter links to other websites for your convenience and information. These websites may operate independently and may have their own privacy notices, statements or policies. We strongly suggest that you review them to understand how your personal data may be processed in connection with those sites, as we are not responsible for the content of non-Philips-owned or managed sites, or the use or privacy practices of those sites.

Changes to this Privacy Notice

The services that Philips provides may change from time to time without prior notice to you. For this reason, we reserve the right to change or add to this Privacy Notice from time to time.

We encourage you to check back often to review the latest version.

The new Privacy Notice will be effective upon posting, if you do not agree to the revised notice you should not visit the website. By continuing to access or make use of the website after those changes become effective, you acknowledge you have been informed of the changes and have reviewed the revised Privacy Notice.

Additional information for California Residents

California Civil Code Section 1798.83 permits our customers who are California residents to request and obtain from us once a year, free of charge, information about the personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year. If applicable, this information would include a list of the categories of personal information that was shared and the names and addresses of all third parties with which we shared information in the immediately preceding calendar year. Pursuant to the California Consumer Privacy Act of 2018 (“CCPA”), we are providing the following details regarding the categories of Personal Information that we collect, use and disclose about California residents. We do not sell and have not sold Personal Information in the preceding 12 months, as “sale” is defined in the CCPA. We do not sell the Personal Information of minors under 16 years of age.

Individual Rights and Requests

If you are a California resident, you may request that we:

Disclose to you the following information covering the 12 months preceding your request:
The categories of Personal Information we collected about you and the categories of sources from which we collected such Personal Information;
The specific pieces of Personal Information we collected about you;
The business or commercial purpose for collecting (if applicable) Personal Information about you; and
The categories of Personal Information about you that we otherwise shared or disclosed, and the categories of third parties with whom we shared or to whom we disclosed such Personal Information (if applicable).
Delete Personal Information we collected from you.

To make a request for the disclosures or deletion described above, please contact us at contact form or 866-309-3263. We will verify and respond to your request as described above in “Your Rights and Choices Available to You” and consistent with applicable law, taking into account the type and sensitivity of the Personal Information subject to the request. We may need to request additional Personal Information from you, such as email address, mailing address and telephone number in order to verify your identity and protect against fraudulent requests. If you make a deletion request, we may ask you to verify your request before we delete your Personal Information.

You have the right to be free from unlawful discrimination for exercising your rights under the CCPA.

Authorized Agents

If you want to make a request as an authorized agent on behalf of a California resident, you may use the submission methods noted above. As part of our verification process, we may request that you provide, as applicable:

Proof of your registration with the California Secretary of State to conduct business in California;
A power of attorney from the California resident pursuant to Probate Code sections 4000-4465;
Written permission that the California resident has authorized you to make a request on the resident’s behalf. This permission must be signed (via physical or e-signature) by the California resident.

If you are making a request on behalf of a California resident and have not provided us with a power of attorney from the resident pursuant to Probate Code sections 4000-4465, we may also require the resident to:

Provide you with a written permission signed by the resident to make the request on the resident’s behalf;
Verify the resident’s own identity directly with us;
Directly confirm with us that the resident provided you permission to submit the request.

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW CAREFULLY.

Why we are providing you with this notice

Respiratory Technologies, Inc., d.b.a. RespirTech is committed to protecting the privacy of your medical information and protected health information (PHI). Federal and state laws require us to protect the privacy of such information and to tell you how we do so. We must give you notice of our legal duties and our privacy practices with respect to your medical information. We are required to do the following:

Maintain the privacy of your medical information.

Notify you if we are made aware that your medical information has been acquired, accessed, used, or disclosed inappropriately.

Explain how, when, and why we may use or disclose your medical information.

Use or disclose your medical information only in the ways we have described in this Notice.

How we protect your health information

We restrict access to your medical information to only RespirTech staff members who provide services to you. All RespirTech staff members have been trained to protect privacy. Staff members who violate these policies are subject to disciplinary action.

We use safeguards to protect your medical information. These safeguards comply with federal regulations regarding security.

We periodically review our policies and practices. We monitor our computer networks. We monitor and test our security to ensure the privacy and security of your health information.

USES AND DISCLOSURES OF YOUR HEALTH INFORMATION

There are a number of ways in which we use or disclose your medical information in providing health services to you.

1.    Uses and disclosures for treatment, payment, or health care operations.

When you first became a patient or customer of RespirTech, you authorized the release of your medical records for the following purposes:

Payment and insurance coverage

Conducting quality of care and performance review

Assuring coordination of medical services

Without further notice to you, RespirTech may use your medical information for the following purposes:

Treatment. We may use or disclose medical information about you to provide you with medical treatment or services and/or to assist medical providers in coordinating and managing your care.

Payment. We may use or disclose your health information so that the treatment and services you receive may be billed to and payment may be collected from you, an insurance company, or a third party. We may also disclose your medical information to contractors who provide claims processing services to RespirTech.

Health care operations. We may use or disclose your health information to perform necessary health plan functions. For example, we may use your data to help us train new staff and to conduct quality improvement activities. We may combine medical information about many patients to decide what additional services to offer and whether certain treatments are effective.

2.    Uses and disclosures authorized by law.

Under certain circumstances, we are authorized by law to use or disclose your health information without obtaining authorization from you and without notifying you of such uses or disclosures. These circumstances may include when the use or disclosure is:

To family members, a personal representative, or others involved in your health care or payment for your health care, unless you tell us not to disclose such information to those individuals.

To business associates, such as to facilitate treatment, payment, and/or health care operations.

For facility directories (such as a hospital), unless you object.

For public health activities, such as when reporting to public health authorities the exposure to certain diseases or reporting data about immunizations.

For health oversight activities, such as when disclosing health data to a state or federal health oversight agency so it can monitor the safety of medical devices.

About victims of abuse, neglect, or domestic violence where required by law.

For judicial or administrative proceedings, such as when responding to a court order.

For law enforcement purposes, such as in response to a subpoena, warrant, or summons.

To a coroner, medical examiner, or funeral director.

To the extent allowed by state workers compensation laws.

To avert a serious and imminent threat of harm to you, another person or to the public.

For certain, specialized government functions, such as regarding military personnel, national security, or prison inmates.

For research purposes, such as for a research project as approved by an Institutional Review Board or Privacy Board, in compliance with governing law.

We may also make disclosures without your consent or authorization when required to do so by state or federal law.

3.    Other uses and disclosures.

We may also use or disclose your health information to contact you for our fundraising activities. If you do not want to be contacted for this purpose, you have the right to opt out of receiving such communications.

4.    Uses and disclosures that require authorization.

For all other purposes, we may be required to obtain a specific authorization to use or release your health information. If you provide an authorization to us, you may revoke it, in writing, at any time.

We will not use or disclose your psychotherapy notes, if applicable, without your prior written authorization, except pursuant to state or federal law.

We will not use or disclose your health information for marketing purposes or accept any payment for marketing communications using such health information without your prior written authorization. The authorization will disclose whether we receive any compensation for any marketing activity you authorize, and we will stop any future marketing activity when you revoke your authorization, in writing, which you may do at any time.

We will not sell your health information without your prior written authorization. The authorization will disclose that we will receive compensation for your health information if you authorize us to sell it. We will stop any future sales of such information when you revoke your authorization, in writing, which you can do at any time.

YOUR INDIVIDUAL RIGHTS

1.    Right to inspect and copy your health information.

You may access, inspect, and receive a copy of your health information contained in our records. You need to make your request in writing. Write or call RespirTech to ask for a “RespirTech Information Access Form.” We may charge a reasonable fee for copies. There are limited situations in which we may deny your request for access. In these situations, we will let you know why we cannot grant your request and how you may ask for a review of our denial.

2.    Right to request an amendment of your health information.

You may request that we amend your medical information. You need to make your request in writing and explain your reason for the amendment. Write or call RespirTech to ask for a “RespirTech Information Amendment Request Form.” Under limited circumstances, we may deny your request. If we do so, you may file a statement of disagreement with us. You may also ask that any future disclosures of your health information include your requested amendment and our denial of your request.

3.    Right to request restrictions on uses and disclosures of your health information.

You may request that we restrict our use or disclosure of your health information for payment or health care operations. You need to make your request in writing. We are not required to agree to your request for a restriction; however, if we do agree, we will comply with our agreement, unless there is an emergency or we are otherwise required to use or disclose the data. If we decide to end our agreement to the restrictions, we will tell you. If you tell us not to disclose medical information to your health plan concerning health care items or services for which you paid for in full out-of-pocket, we will abide by your request, unless we must disclose the information for treatment or legal reasons.

4.    Right to request confidential communications.

You may request that we communicate with you in a specific way or at a specific location. For example, you may request that we contact you at a particular email account or at an address other than your home address. We will agree to your request if we determine that your request is reasonable. You need to make your request in writing.

5.    Right to request an accounting of disclosures of health data.

You may request a listing of certain disclosures we have made of your health information. You need to make your request in writing. You may ask for disclosures made up to six (6) years before the date of your request. We will provide you with one accounting in any 12-month period free of charge. For additional accountings, we may charge you for the costs of providing the listing.

6.    Right to receive a copy of this notice.

You have the right to receive a paper copy of this Notice at any time. To exercise any of these rights, contact our Privacy Officer at the telephone number or address listed below.

CHANGES TO THIS NOTICE OF PRIVACY PRACTICES

RespirTech reserves the right to amend this Notice at any time in the future. Until such amendment is made, we are required by law to comply with the terms of this Notice currently in effect. After an amendment is made, we will make available to you a revised Notice of Privacy Practices which will apply to all PHI that we maintain, regardless of when it was created or received.

QUESTIONS OR COMPLAINTS

If you are concerned that your privacy rights have been violated, you may file a complaint with RespirTech or with the Secretary of the U.S. Department of Health and Human Services. You will not be retaliated against for filing a complaint.
