MEDICARE FRAUD AND ABUSE STATUTE

Violations of Medicare laws and the Medicare Fraud and Abuse Statute also constitute violations of the False Claims Act. durable goods providers, hospitals, clinics, pharmacies, or laboratories to name a few, that seek and receive reimbursement for Medicare and Medicaid funds are Government contractors subject to the False Claims Act.

All RespirTech employees should pay particular attention to our services provided and our business practices. Not only can this improve the healthcare for patients and loved ones, but it also helps ensure that public Medicare and Medicaid monies are properly spent in accordance with the law and good medical practice.

Fraud may include billing for services not rendered, misrepresenting the type of goods or services rendered, misrepresenting the nature of the patient's illness, providing kickbacks to a medical provider in order to induce the provider to prescribe certain devices, prescribing unneeded treatment that is not a medical necessity, charging Medicare or Medicaid patients a higher rate than others for the same prescription, or knowingly providing defective products or services. In addition falsely diagnosing a more severe ailment than the one the patient actually has, known as "up-coding" a diagnosis, thereby justifying a more expensive drug therapy or other treatment than that which the patient's health really requires. Inappropriate changes in patients' prescriptions from one device to another as a result of kickbacks or for other improper reasons or falsely reporting research grant information to government agencies may all trigger False Claims legal action.

RespirTech strives to maintain a legal and ethical work environment not only for our customers, but also for our employees and contracted staff. It is imperative that any potential, suspected or actual abuse be reported immediately to the CEO, the Human Resources Department or through an established email address for employees and customers to use if anyone believes an issue need to be addressed to: privacyofficial@respirtech.com.

The Human Resources Department monitors and addresses all communications through this email address. All reports made through this reporting system will remain confidential, unless legal action is required and the reporting person’s testimony is required. Federal and state Whistleblower laws protect individuals who report abuses.

WHISTLEBLOWER STATUTE

The Whistleblower Protection Act protects you from harassment, demotion and wrongful termination for reporting fraud. Because of the law, you can file a whistleblower claim knowing that you are protected from retaliation. In 1986, Congress added anti-retaliation protections to the False Claims Act.

Any employee who is discharged, demoted, suspended, threatened, harassed, or in any other manner discriminated against in the terms and conditions of employment by his or her employer because of lawful acts done by the employee on behalf of his employer or others in furtherance of an action under this section, including investigation for, initiation of, testimony for, or assistance in an action filed or to be filed under this section, shall be entitled to all relief necessary to make the employee whole.

The protection against retaliation extends to whistleblowers whose allegations could legitimately support a False Claims Act case even if the case is never filed. The statute of limitations for Sec. 3730(h) claims is 6 years in most jurisdictions. Check with your legal counsel.
